“murder” is when a person of sound memory and of the age of discretion, causes the death of any other person with malice aforethought, either expressed by the party or implied by law. A death will be treated as murder even if the defendant did not wish to kill the actual victim if:
(a) person B intended serious harm to one or more persons, but an unintended other person dies as a result;
(b) the death occurs as the result of the perpetration of, or attempt to perpetrate, any arson, escape, murder, kidnapping, treason, espionage, sabotage, aggravated sexual abuse or sexual abuse, child abuse, burglary, or robbery
(c) Several people share an intent to do serious harm, and the victim dies because of the action of any of those involved.
