responsible for the girl¹

“responsible for the girl¹” means a person is “responsible” for a girl in either of the following two cases.

(a)          where the person—

i                    has parental responsibility for the girl, and

ii                  has frequent contact with her.

(b)          where the person—

i                    is aged 18 or over, and

ii                  has assumed (and not relinquished) responsibility for caring for the girl in the manner of a parent.

For the purposes of subsection (a) ii, where a person has frequent contact with a girl which is interrupted by her going to stay somewhere temporarily, that contact is treated as continuing during her stay there.
